Your Will is an important document!  

Only the Original Will can be admitted in the Courts. Hence it is VERY important that you keep your Will safely!

Once your Will has been drawn up, signed, dated and witnessed, it should be kept in a safe, easy to access place, as it is a very important legal document. Any damage to the Will document can lead to challenges made in court and legal problems with the administration of your estate. Loss of the Will document will of course, cause even greater problems as there will be no formal record of your wishes.

Three (3) Main Considerations when keeping your Will:

Your Will should be kept in a place where access is limited so no one can tamper with your Will.

Your Will should be kept in safe place, away from fire hazard, theft and destruction.

You should make sure your Executors know the location of your Will, and how to access it when the time comes for it to be executed.

While writing a WILL is important, it is equally important to ensure that proper steps are taken to make your WILL available when it is needed most.

Common places to keep your Will:

You can keep your Will in a financial institution's safe deposit box.  However, the smallest safe deposit box will cost you about at least S$90 per year, not to mention that you have to keep an account with the financial institution.  Furthermore, what happens when you passes away?  Who will have access to the safe deposit box then?  Your executor will not have access to your deposit box if you did not leave proper instructions to the banks.  You will need to check with your bank about their requirements on your passing.

If you choose to keep your Will at home, there is no guarantee that it will be protected from fire, theft, flooding or pests.  Or you may simply misplace your Will.  In addition, it must be accessible to the executor. If you do decide to store your Will at home you will need to tell someone you trust where you have put it, so that it can be found after your passing. This is very important, because if the original, signed Will is not found, your estate would be treated as if you had died intestate, and your assets might not be distributed as you would have wished.

Frequently Asked Questions (FAQ):

Q1:  Who will know that my Will is deposited with your company?

Ans:  Firstly, we will deposit your Will Information with the Wills Registry - an online database maintained by the Singapore Academy of Law under Ministry of Law.  Secondly, each of your Executors will receive a "Wills Deposit Certificate" listing down the procedure of withdrawal of the Original Will. When the testator/testatrix passed away, the Executor will notify us (based on the information inside the Will Deposit Certificate) and we will give back the Original Will to the Executor within 48 hours.

Wills Retrieval Procedures:

Step 1:  When you sign up the Wills Custody Service, we will issue you and your Executors a "Will Deposit Certificate".

Step 2:  When the time comes, only the Certificate holder (i.e. the Executor(s) or your closest next-of-kin) will know that the Will is kept with us.  The Certificate holder must then contact our office, and show proof of the testator's death by producing the death certificate.

Step 3:  We will arrange to take out the original Will from our depository, and arrange to meet up with the Certificate Holder, PLUS in the presence of at least one witness, who is usually the Probate Lawyer.

Step 4:  Once the original Will is given to the Certificate Holder (who is usually the Executor), the Certificate Holder will then sign an acknowledgement that he or she has taken the Original Will.  We will keep a copy of the person's NRIC as record.

Q2:  How do you ensure my Will is safe?

Ans:  Your Will is kept with Certis Cisco - protected by trained Auxiliary Police Officers and Specialized Security Equipment that is fire-proof!  The premise is under 24 hours surveillance and only Authorized Officers of The Legacy Protector Pte Ltd will have access to the safe deposit boxes.

Q3:  What happens if your company is no longer around?

Ans:  We are a Singapore Registered Private Limited Company which has to comply with Singapore Law should the company be folded due to whatever reasons.  When this happens, we will have procedures in place to retrieve the Wills from Certis Cisco and return to you in accordance to our Terms and Conditions.

Q4:  How fast can I retrieve my will?

Ans:  Certis Cisco is open every day and hence our SLA - Service Level Agreement is to give you back your Will within 48 hours after you have informed us.

Q5:  Are there any refund for early termination of this Service?

Ans:  There is no early termination fees.  However, if the company is closed for whatever reasons, refund is possible with the return of your Original Wills to you, in accordance to our Terms and Conditions.
